These Referral Program Terms (“Terms”) govern participation in the MyNetDiary / PlateAI Referral Program (“Program”). By participating, you agree to these Terms, our Terms of Use, and our Privacy Policy.

1) Definitions

• Company: MyNetDiary, Inc.
• Referrer: Any individual or entity sharing a referral code (does not need to be a current user).
• Referred User: A person new to PlateAI/MyNetDiary who signs up and enters a valid referral code during account creation.
• Qualified Referral:A Referred User who (a) enters the Referrer’s unique code during sign up, (b) starts a paid subscription billed to their account (not via Family Sharing/Share with Family), and (c) remains in good standing through the Verification Period (Section 5).

2) Eligibility

• Open to individuals 18+ (or age of majority) where lawful. Void where prohibited.
• Referrers may be users, creators, or organizations. A payout account with our third-party payout service is required to receive rewards.
• Referred Users must be new (no PlateAI/MyNetDiary account, subscription, or trial within the prior 12 months tied to the same email, device, or payment method).

3) How It Works

• Company issues a unique referral code to the Referrer.
• The Referred User must enter the code during sign up in the app/website. Codes cannot be added retroactively or after account creation.
• Only one referral code may be used per sign up; if multiple codes are attempted, the last code entered during sign up applies.

4) Rewards & Payouts

• Standard Referrer Reward: $10 USD per Qualified Referral.
• Lifetime Premium Bonus: After the Referrer earns five (5) Qualified Referrals, Company will also award the Referrer a MyNetDiary Lifetime Premium membership (one-time per Referrer; non-transferable; no cash value). For purposes of Lifetime Premium, "lifetime" has the meaning set forth in our Terms of Use.
• Payout Threshold: Payouts are initiated after the Referrer has four (4) Qualified Referrals in their payout balance. If the payout service enforces a higher minimum, the higher minimum applies.
• Alternative Arrangements: Different rates/structures (e.g., higher bounties, tiered payouts, or other incentives) may be agreed in writing on a case-by-case basis (e.g., for influencers/partners).
• Payout Method: Rewards are paid via a third-party payout service that offers multiple payout options depending on your country, such as Physical Visa, Virtual Visa, Amazon Gift Card, Starbucks USA Gift Card, PayPal (USA),PayPal (International), Venmo. Service fees and minimum payout thresholds may apply per that service’s rules.
• Referred User Benefits: From time to time, a referral code may unlock promotional benefits (e.g., extended trial or discount) where permitted; availability is not guaranteed and may vary by platform and region.

5) Verification Period & Timing

• Rewards are added to your payout balance after a 30-day Verification Period starting on the Referred User’s first paid charge.
• If the Referred User cancels, receives a refund/chargeback, or the payment fails within the Verification Period, the referral will not qualify for a payment to the Referrer.
• Payout timing follows the third-party payout service’s disbursement schedule after verification.

6) Limits & Program Controls

• Paid Referral Cap: Company will pay rewards for up to twenty (20) Qualified Referrals per Referrer (lifetime cap), counted across all referral codes, accounts, payout profiles, and payment credentials reasonably determined to be associated with the same individual or entity (e.g., same tax ID, payout account, email, device, or payment method). Qualified Referrals beyond this cap are not eligible for rewards unless expressly permitted in a written Alternative Arrangement (see Section 4).
• A Referred User may receive only one code benefit. Multiple accounts for the same person, household, device, or payment method may be disqualified.
• The Company may implement additional throttles or pause the Program at any time to protect against fraud or abuse. Any such measures will not increase the Paid Referral Cap absent a written Alternative Arrangement.

7) Tracking & Attribution

• Attribution is based solely on the referral code entered during sign up.
• Codes cannot be credited after account creation, and we do not honor screenshot/email proofs.
• If a code is shared publicly and multiple codes are available, only the code actually entered during sign up is credited.

8) Acceptable Sharing & Prohibited Conduct

Allowed: Public sharing (e.g., social media, website, newsletter, podcast).

Not allowed (without prior written approval):

• Spam, bulk unsolicited messages, or misleading claims.
• Paid ads bidding on PlateAI/MyNetDiary brand terms or confusingly similar trademarks.
• Posting to coupon/deal-aggregator sites or running offer walls/incentivized traffic networks.
  Always prohibited: Self-referrals; referrals from the same device, payment method, or household; fake/duplicate accounts; bots; VPN/proxy abuse; or any activity intended to “game” the Program.
  We may void referrals, withhold or claw back rewards, and suspend accounts for violations or suspected fraud.

9) Changes, Suspension, Termination

We may change, suspend, or terminate the Program or these Terms at any time with or without notice. Changes won’t affect rewards already disbursed but may affect pending or future referrals.

10) Privacy

Participation involves processing data necessary to administer the Program and prevent fraud, including referral codes and subscription status. See our Privacy Policy for details.

11) Disclaimers & Liability

• Rewards and promotional benefits are provided “as is.” We are not responsible for lost, delayed, or undeliverable communications or payouts caused by third parties.
• Apple and Google are not sponsors of this Program and are not responsible for its administration. App Store/Google Play terms apply to subscriptions.
• To the fullest extent permitted by law, our total liability related to the Program will not exceed the aggregate rewards paid to you in the six (6) months preceding the claim.

12) Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflicts of law. Exclusive venue lies in the state or federal courts located in New Jersey.
