Effective Date: November 5, 2026.
This Consumer Health Data Privacy Policy applies to Nevada consumers under Nevada Senate Bill 370 (NRS Chapter 603A). It supplements our Privacy Policy, which also applies to you. MyNetDiary Inc. ("MyNetDiary," "we," or "us"), 621 NW 53rd St., Suite 240, Boca Raton, FL 33487, USA, provides the MyNetDiary website and mobile applications (the "Service").
1. Consumer Health Data We Collect and Why
"Consumer health data" means personal information that is linked or reasonably linkable to you and that identifies your past, present, or future health status. The categories we collect are: weight, height, and body measurements; diet, nutrient, water, and fasting entries; exercise, activity, heart rate, and sleep; blood glucose, A1C, blood pressure, carbohydrate and insulin entries; medications, including GLP-1 and similar medications; health goals and conditions you record; meal photos, progress photos, and voice entries that reveal health information; health data from devices and services you connect; the fact that you use an app designed for a specific health condition; and inferences derived from the above.
We collect this data directly from you, from devices and services you connect, and by deriving it from information you provide. We use it only to provide the features you request, personalize your targets and insights, provide AI Features you choose to use, sync with services you connect, keep the Service secure, and comply with law. We do not use it for advertising or marketing, and we do not sell it.
2. Consumer Health Data We Share
We share consumer health data only with: our service providers, which are Google for hosting and storage, Zendesk for customer support, and OpenAI for AI Features, with no permission to train its models on the data; services you choose to connect, such as Apple Health, Google Health Connect, Google Health, Oura, ChatGPT, and other apps and devices you choose to connect, at your direction; healthcare professionals or other people you choose; and government authorities when legally required. We disclose to these service providers the consumer health data needed for hosting and storage, customer support, and the optional AI Features you use, and we disclose information to connected services and other recipients only at your direction. The information shared depends on the service involved: our hosting provider processes the health information stored in your account; our support provider processes health information you include in support requests; our AI provider processes the information needed to provide the AI Features you choose to use; and connected services receive the categories of information you authorize. We do not share consumer health data with affiliates or with advertising, analytics, or mobile measurement partners.
We do not permit third parties to collect consumer health data about you over time and across different websites or online services through our Service.
3. Consent
We collect and use consumer health data to the extent necessary to provide the products and services you request. For collection or sharing that requires additional affirmative consent under Nevada law, that consent must be obtained before the activity takes place. General acceptance of our Terms of Use and Privacy Policy does not, by itself, constitute separate consent for activities requiring it. We share consumer health data with anyone other than our service providers only at your direction. We do not sell consumer health data.
4. Reviewing and Correcting Your Data
You can review and correct your consumer health data at any time in the Mobile Apps or on the Website, or by contacting us.
5. Your Rights
You have the right to confirm whether we collect, share, or sell your consumer health data and access it, including a list of the third parties and affiliates with which we have shared it and their contact information; to withdraw consent you have given for future collection or sharing of it; and to have it deleted. After verifying your deletion request, we will delete the requested consumer health data from our active records within 30 days, subject to applicable legal exceptions, notify the recipients with which we shared it, and address archived and backup copies as Nevada law requires. To exercise these rights, email support@mynetdiary.com. We will verify your request by asking you to confirm it from inside your account or through the email address on your account if you have one; if you have no email address or cannot access your account, contact support@mynetdiary.com for another available verification procedure. We will respond within 45 days, and may extend that period by 45 days when reasonably necessary, with notice. You will not be charged or discriminated against for exercising these rights.
Appeals. If we deny your request, you may appeal by emailing support@mynetdiary.com with the subject line "Health Data Request Appeal." We will respond in writing within 45 days. If your appeal is denied, you may contact the Nevada Attorney General at https://ag.nv.gov.
6. Geofencing
We do not use geofencing around facilities that provide in-person health care services.
7. Changes to This Policy
We will post any changes with a new effective date. If we make a material change, we will notify you in advance by email or in-app notice and, where the law requires, ask for your consent before applying it to consumer health data we already hold.
